Section 11 — Preliminary Notification

The Collector publishes a preliminary notification announcing intent to acquire identified land — triggering the objection window and formal acquisition proceedings.

What is a preliminary notification?

Section 11 authorises the Collector to publish a preliminary notification in the Official Gazette and locally, stating that land in a specified area is needed for a public purpose. From this date, certain legal consequences follow — including restrictions on land transactions and the right of affected persons to object.

Contents of the notification

  • Public purpose of acquisition
  • Description of boundaries / survey numbers
  • Name of requiring body (e.g. NHAI, PWD, district)
  • Date from which land is marked for acquisition
  • Information on where maps/plans can be inspected

Workflow after publication

  1. Gazette & local publication

    Notification in Rajpatra / e-Gazette and panchayat / tehsil offices.

  2. Land transaction restrictions

    Section 11(4) — restrictions on transfers and new construction without Collector permission.

  3. Objection window opens

    Affected persons may file objections u/s 15 within the statutory period.

  4. Preliminary report prepared

    Collector's office compiles land schedule, maps, and SIA/R&R summary.

Important distinction

Preliminary notification under Section 11 is not the final declaration of acquisition (Section 19). It announces intent and starts the process — owners still have rights to object and be heard.
