Stage 05 Section 8 · RFCTLARR

Section 8 — Government Decision on SIA

After expert appraisal, the Appropriate Government formally accepts or rejects the SIA — determining whether the project may move to preliminary notification.

Government decision point

Section 8 is a critical gate: the Appropriate Government, after considering the SIA report and Expert Group recommendations, passes an order either accepting the SIA (possibly with modifications) or declining to proceed. If rejected, acquisition under LARR cannot continue without a fresh process.

Possible outcomes

Accepted

SIA approved — project proceeds to Section 11 preliminary notification with stated R&R conditions.

Accepted with modifications

Government requires changes to R&R plan or project scope before notification.

Rejected

Acquisition stalled — project authority must revise proposal or abandon acquisition.

Workflow

  1. Expert report received

Administration consolidates SIA + Expert Group findings.

  2. Departmental review

Revenue, project, and legal wings vet the package.

  3. Government order u/s 8

Signed order published — acceptance or rejection recorded.

  4. If accepted → Section 11

Collector authorised to publish preliminary notification.
